Non-Disclosure Agreements Discovered through Records Request

Judge Keith Lutz told KSAT in October 2025 that he hadn’t signed NDAs with data centers, but our research shows he signed an NDA with Rowan Digital Infrastructure in March 2025

 

Two documents show that Medina County entered confidentiality agreements with major data-center companies through sitting County Judges. Then-County Judge Chris Schuchart signed a Microsoft confidentiality agreement in September 2018, and County Judge Keith Lutz signed a Mutual Non-Disclosure Agreement with Rowan on March 6, 2023. The Rowan agreement covered not only confidential information, but also disclosure that a possible transaction was being considered or that discussions or negotiations were occurring.

In an October 3, 2025 KSAT interview and accompanying report, however, Lutz was reported as saying that he had not signed an NDA with Rowan or another developing data center. The documents raise legitimate questions about what transactions were contemplated, whether Commissioners Court authorized the agreements, and what County business was conducted while the agreements were in effect.
